DECREE REGULating ORGANIZATIONS AND SPECIALIZED DEPARTMENTS ON ENVIRONMENTAL PROTECTION AT STATE AGENCIES AND STATE ENTERPRISES

Decree |
1. This Decree guides the implementation of the 2005 Law on Environmental Protection on organizations and specialized environmental protection departments at state agencies and state-owned enterprises.
2. This Decree applies to:
a) Professional organizations on environmental protection of ministries, ministerial-level agencies, and agencies under the Government (hereinafter collectively referred to as Ministries);
b) Organizations and specialized environmental protection departments of specialized state management agencies and specialized law enforcement agencies (hereinafter referred to as Departments and General Departments) under ministries and ministerial-level agencies ;
c) Professional organizations on environmental protection under the Department of Natural Resources and Environment (hereinafter referred to as specialized organizations on environmental protection under the Provincial People's Committee);
d) The specialized environmental protection department of the Department of Natural Resources and Environment under the People's Committee of the district, town, or provincial city (hereinafter referred to as the specialized organization on environmental protection under the People's Committee of the province). District People's Committee);
d) Cadastre - Construction civil servants of communes, wards and towns (hereinafter collectively referred to as commune-level Cadastre - Construction civil servants);
e) Professional organizations and officers in charge of environmental protection at the Management Board of industrial parks, export processing zones, high-tech zones, economic zones and Management Boards with other names (hereinafter referred to as Management of economic zones);
g) Professional organizations and officers in charge of environmental protection at companies, corporations, and state-owned economic groups (hereinafter collectively referred to as state-owned enterprises).
3. Subjects not subject to this Decree include:
a) Responsible inter-sectoral consulting and coordination organization related to environmental protection;
b) Public service units (except for state service units serving state management under specialized agencies on environmental protection specified in Points a, b and c, Clause 2 of this Article);
c) Vietnam Environmental Protection Fund; Environmental Protection Fund of ministries, branches and localities;
d) Enterprises providing environmental protection services;
d) Non-governmental organizations, self-governing organizations of residential communities performing environmental hygiene and environmental protection services as prescribed in Article 116 of the Law on Environmental Protection.
